Terms of service
1. Introduction
These General Terms and Conditions (hereinafter "GTC") of Sana Sport Club GmbH (hereinafter "Sana") apply to all services and products (hereinafter "Products") of the online shop of Sana Sport Club GmbH. All other services are regulated in separate terms and conditions. A customer is defined as any natural or legal person who has a business relationship with Sana.
2. Scope of the GTC
The GTC apply to all products or services offered by Sana in the online shop. Sales and deliveries are made exclusively under these GTC. Opposing or deviating terms and conditions of the customer will not be recognized unless Sana has expressly agreed to their validity in writing. The binding version of the GTC is published at www.sanasportclub.ch/allgemeine-geschaeftsbedingungen/.
3. Pricing
All prices from Sana are inclusive of VAT unless otherwise stated. For visitors from outside Switzerland, prices are shown excluding VAT.
4. No Gurantee for Product Information and Availability
Sana strives to inform and educate customers as best as possible about the offered products and services. These details are partly obtained directly from manufacturers or suppliers and compiled clearly and customer-friendly by Sana. Any information regarding products, services, recommendations, warranty conditions, and warranty periods published by Sana is therefore provided without guarantee and should not be interpreted as a warranty. In particular, no liability is accepted for the accuracy, completeness, and timeliness of the information.
Sana carefully maintains availability details but delivery delays may occur due to production or delivery bottlenecks or incorrect stock data. All delivery time information is non-binding and can change at any time without notice. Delivery may also become impossible if a product is no longer manufactured or available. In such cases, the delivery option pursuant to section 5 of the GTC applies.
5. Contract Conclusion
The products, services, and prices published on www.sanasportclub.ch are considered an offer (quotation). This offer is subject to the (resolutive) condition of delivery impossibility or incorrect pricing (by the manufacturer or Sana). This means delivery may not occur if articles are no longer available.
The contract is concluded as soon as the customer places their order via the online shop, phone, or email. Receipt of the order is confirmed with an automatically generated order confirmation email. This confirmation does not guarantee that the product is actually available or can be delivered—it only informs the customer that the order has been received and that the contract has been concluded under the resolutive condition of non-delivery.
If one of the above (resolutive) conditions occurs, the contract is immediately and automatically dissolved without the need for action by either party. In such cases, Sana will inform the customer immediately. If the product has already been delivered, ownership automatically reverts to Sana and the customer must return it (Sana will refund the paid amount). If delivery has not yet occurred, the customer is neither obliged to pay nor to accept delivery. Sana is not obliged to make a replacement delivery.
6. Payment Terms
The customer agrees to use the payment options provided by Sana. Currently, payment can be made using supported credit cards (Stripe), Direct Bank Transfer, or PayPal. After purchase, a receipt is emailed to the customer, and the order is prepared for shipping.
Products remain the property of Sana until full payment is received. The customer allows Sana to register a retention of title if necessary.
7. Delivery
Unless otherwise agreed, delivery is made from the warehouse to the address provided by the customer. Unless otherwise stated in the product description, all offered items are ready for dispatch within 5 working days. Shipping times begin the day after payment is made (for Direct Bank Transfer) or the day after contract conclusion for other payment methods. For international shipping, additional costs for VAT and customs clearance may arise, which are the customer's responsibility.
8. Payment Default
If the customer fails to meet their payment obligations in full or in part, all outstanding amounts become immediately due. Sana may suspend all deliveries and cancel orders after a 7-day grace period following a payment reminder.
9. Returns
Returnable items can be sent back within 14 days of receipt. Items must be new, unworn, unwashed, and in their original condition with labels and packaging. If returned items are not in new condition, Sana may refuse the return or charge a reconditioning fee of 15 CHF, deducted from the refund. Return shipping and any related customs costs are the customer's responsibility unless the item is defective or incorrectly delivered.
Sana recommends international customers contact info@sanasportclub.ch before returning to avoid customs complications and high return costs.

The right of return does not apply to:

Items from special sales (e.g., clearance, special offers)

Items marked "excluded from exchange and return"
If these items are defective or incomplete, they may be returned for exchange or refund.
10. Scope of the GTC
Exchanges are only possible by returning and placing a new order. Customers can return products within the specified period (see section 9). Sana will refund the returned product, and the customer can reorder the desired product.
11. Warranty
Warranty claims follow statutory provisions. Customers must check products immediately upon receipt and report any defects (visible or hidden) within 7 days. The product must remain unused and in the delivery condition for claims to be processed. Warranty is void in case of improper use or natural wear. Sana reserves the right to decide on warranty cases individually.
12. Repairs
For warranty repairs, Sana recommends local repair and covers the costs upon prior agreement. Contact info@sanasportclub.ch to arrange.
13. Liability
Claims for damages are excluded unless caused by intentional or grossly negligent conduct. Any liability for indirect or consequential damages is excluded.
14. Changes to the GTC
We reserve the right to amend these GTC at any time without notice. The version published at www.sanasportclub.ch/allgemeine-geschaeftsbedingungen/ applies.
15. Governing Law
All matters are subject to Swiss law. The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
16. Juridsiction
Jurisdiction is Dottikon unless otherwise required by law. Sana may also sue the customer at their place of residence or other competent court.
